Italian and German legislation laying down such a rule is justified by the objective of ensuring that the provision of medicinal products
to the public is reliable and of good quality. Today, the European Court of Justice (ECJ) has brought to a close two sets of proceedings
relating to the system of pharmacy ownership (Commission v Italy and Apothekerkammer des Saarlandes and Others). With this decision,
the ECJ followed the recommendation of Advocate General Yves Bot who had also voted in favour of the ban on outside ownership
in his opinion on 16 December 2008.
